Terms of Service

1. Acceptance of Terms

By accessing or using the Mybor platform, including our website and mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Mybor is a community communication platform designed for residential buildings, HOAs, and managed communities. The Service provides verified membership, announcements, messaging, event management, and administrative tools to help communities communicate securely and effectively.

3. User Accounts

When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Harass, bully, threaten, or intimidate other users
  • Post spam, unsolicited advertisements, or promotional material
  • Share illegal, defamatory, obscene, or harmful content
  • Impersonate another person or misrepresent your identity or community affiliation
  • Distribute malware, viruses, or any other harmful software
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts
  • Scrape, crawl, or use automated means to extract data from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Violate any applicable local, state, national, or international law

5. User Content

You retain ownership of all content you post, upload, or share through the Service ("User Content"). By submitting User Content, you grant Mybor a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content. You represent that you have the right to share any content you post and that your content does not infringe the rights of any third party.

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to the community or the Service.

6. Community Guidelines

Mybor is designed to foster respectful, productive communication within residential communities. All users are expected to:

  • Communicate respectfully with neighbors and community members
  • Keep discussions relevant to your building or community
  • Respect the privacy of other residents
  • Follow any additional guidelines established by your community administrators
  • Report violations or concerns to your community administrator or to Mybor support

7. Property Manager Responsibilities

Users with administrator or property manager roles have additional responsibilities, including:

  • Managing community membership by approving, inviting, and removing members
  • Moderating content to ensure it complies with these Terms and community standards
  • Configuring community settings, roles, and permissions appropriately
  • Handling resident concerns and disputes within the community in good faith
  • Ensuring that only verified, authorized residents have access to the community

Property managers act on behalf of their community, not on behalf of Mybor. Mybor is not responsible for the actions or decisions of community administrators.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.

You may delete your account at any time by contacting us or using the account settings in the app. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Mybor does not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy or completeness of any content posted by users. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Mybor and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you have paid to Mybor in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Texas.
